On Retaining Divisions B and C

Bill Analysis

HR 6938 is a consolidated FY2026 appropriations bill providing full-year discretionary funding for three major spending areas: (1) Commerce, Justice, Science (CJS); (2) Energy and Water Development (E&W); and (3) Interior and Environment. It is a regular appropriations measure, not an authorization bill, so it primarily sets spending levels and conditions rather than creating new permanent programs.

For the CJS division, the bill funds the Department of Commerce (including NOAA, NIST, Census Bureau, and economic development programs), the Department of Justice (FBI, DEA, ATF, U.S. Marshals, U.S. Attorneys, Bureau of Prisons, and grant programs such as Byrne JAG and Violence Against Women Act programs), and science agencies (NASA, NSF, and related offices). It specifies program-by-program allocations, hiring and reporting requirements, and restrictions on use of funds (e.g., for grants, research priorities, law enforcement activities, and data collection).

The Energy and Water Development division funds the Department of Energy (DOE), including the National Nuclear Security Administration (nuclear weapons complex, nonproliferation, naval reactors), energy efficiency and renewables, fossil energy, nuclear energy, grid and transmission R&D, and basic science at the Office of Science. It also funds the Army Corps of Engineers’ civil works (navigation, flood control, ecosystem restoration), the Bureau of Reclamation (Western water projects), and related independent agencies. It typically includes earmarked project funding, cost-share conditions, and direction on infrastructure, climate, and energy technology portfolios.

The Interior and Environment division funds the Department of the Interior (National Park Service, Fish and Wildlife Service, Bureau of Land Management, Bureau of Indian Affairs and Indian Health Service, U.S. Geological Survey), the Environmental Protection Agency (EPA), and related cultural and environmental agencies. It covers land management, tribal programs, environmental regulation and enforcement, Superfund, and state and local water and wastewater infrastructure grants.

Beneficiaries include federal agencies, state and local governments, tribes, research institutions, contractors, and grantees; regulated entities are indirectly affected through funded enforcement and regulatory activities. The bill governs spending for FY2026 (October 1, 2025–September 30, 2026), with many provisions taking effect at enactment and expiring at the end of the fiscal year unless expressly continued.
